The Moscow Region Business Ombudsman Vladimir Golovnev informed of that case, having considered the arguments of an entrepreneur's appeal, who concluded a contract with a municipal budgetary entity "Olympic Reserve  School of Bobrov V. M." for the supply of cupboards and fences.

    “In accordance to the part 1 of the article 7.32.5 of CAVL of Russian Federation, the official's violation of the municipal contract requirements in state and municipal procurement, including fund advances is punishable by an administrative fine of between 30 and 50 thousand of rubles. Furthermore, a disqualification provided for up to two years in the event of the repeated offence.”-reminded the Moscow Region Business Ombudsman Vladimir Golovnev.

Previously he had received an application from entrepreneur with information of contract payment breach signed by 31.12.19 year.

    According to the information from Portal contract management, the contract price is 81 thousand rubles. Acts of good acceptance from 22.01.20, that were signed from 24.01.20, indicate full performance of the contract by businessman. The contract payment has been made in full by 28.02.20, that confirms by invoice from 27.02.20.

    According to the contract terms, the payment is available by goods delivered and related acts signed, by bank transfer into supplier's account within 30 days.

    "The employer was obliged to pay by February 24 of 2020 under the contract. Due to the breach of the contract obligations, the issue of administrative proceedings is being initiated now in the Moscow Region Office of the Auditor General, according to the part 1 of the article 7.32.5 of CAVL of Russian Federation. We do not understand the reasoning of officials being inactive, which could lead to a fine of 2/3 total contract price. "- noted the Commissioner for the Protection of the Entrepreneur's Rights in the Moscow Region Vladimir Golovnev.
