The court's decision: there was no intent, a court fine instead of a prison term.

    An entrepreneur from Voskresensk urban district appealed to the Moscow Region Business Ombudsman Vladimir Golovnev with a request of considering the situation with criminal procecution. 

According to the words of a 59-year-old businessman, “instead of an administrative one, a criminal case was opened” under the article, which provides for punishment up to 5 years in prison.  As a result of the consideration of the appeal and the checks carried out, the case was sent to the city court, which made a decision, adequate to the circumstances of the case, to impose a court fine.

     The Commissioner for the Protection of Entrepreneurs' Rights in the Moscow Region  received an appeal from the CEO of LLC with a complaint about a criminal investigation in the city department of the Ministry of Internal Affairs of Russia.

    It followed from the application that at the beginning of November 2020, as a result of an inspection of the premises located on the land of the LLC in the Voskresensk urban district, representatives of the internal affairs revealed the residence of three citizens of the Republic of Tajikistan with expired registration in the Russian Federation.

    A criminal case has been initiated against the CEO (the applicant) on the grounds of a crime under Article 322.1 Part 1 of the Criminal Code of the Russian Federation “Organization of Illegal Migration”.

     “In December 2020, this entrepreneur came to a joint reception, which we held with the Moscow Region prosecutor.  The regional prosecutor's office took the case under special control.  After examining the case materials, it became clear that the entrepreneur had no intention of organizing the illegal stay of foreign citizens on the territory of the Russian Federation.  At the end of 2020, a criminal case opened against an entrepreneur, was sent in accordance with Part 2 of Art.  446.2 of the Criminal Procedure Code of the Russian Federation for consideration in the Voskresensky City Court.  The result of the trial was a fine in the amount of 20 thousand rubles”, explained Vladimir Golovnev, the Moscow Region Business Ombudsman.

    “Behind each dry wording "criminal case" is the fate of a person, a formal approach when considering appeals is absolutely inappropriate.  This entrepreneur conducts an honest business, pays taxes and insurance premiums, provides jobs for residents of the Moscow Region.  Moreover, the businessman was not the initiator and organizer of the illegal migration of citizens of a foreign state”, said Vladimir Golovnev, following the consideration of the case in the court.
