After the intervention of the Moscow Business Ombudsman, the companies will pay the debt for the work performed.
The Commissioner for the Protection of the Rights of Entrepreneurs of the Moscow Region Vladimir Golovnev was approached by a limited liability company.
The essence of the complaint was the improper performance by the municipal state institution of the payment deadlines for the contracts executed by the company.
The company has concluded a series of contracts with the municipal enterprise for the maintenance of municipal industrial and communal facilities (boiler houses, sewage pumping stations, water intake units, sewage treatment plants). The necessary materials were purchased, all the work was carried out in accordance with the contracts.
On the part of the customer, there was an overdue debt for the payment of works, delivered materials and spare parts in the amount of more than 4 million rubles.
Having studied the materials of the appeal: acts signed by both parties confirming the volume and cost of the work performed and other documents – the business Ombudsman came to the conclusion: the municipal customer violated the rights and legitimate interests of the entrepreneur.
The authorized representatives sent a letter to the head of this enterprise and offered to pay the debt in a pre-trial manner.
As a result of the actions taken, an agreement was concluded between the customer and the contractor on debt restructuring by providing installments. Until the full fulfillment of obligations under the terms of the agreement, the issue remains under the control of the Commissioner.
